Terms of Service

These terms govern your use of Two Spouts Analytics (“Kite”, “we”, “us”) at analytics.hexgeta.com. By creating an account or using the service you agree to them. If you use Kite on behalf of a business, you agree for that business.

1. The service

Kite provides website analytics, ad and search performance reporting, AI-generated insights, and tools to manage connected advertising accounts. Features may change over time. Some features are provided only to clients of Two Spouts or under a separate agreement, which takes precedence over these terms where they conflict.

2. Accounts

• You must give accurate information and keep your login secure.
• You are responsible for activity under your account and for the people you invite.
• Tell us promptly at michael@twospouts.com if you suspect unauthorised access.

3. Your data and your websites

• You own the data you put into Kite and the data collected from your websites and accounts.
• You grant us permission to process it only to provide and improve the service for you.
• If you install the tracker on a website, you are responsible for having a lawful basis to measure its visitors and for any notices or consents your visitors’ laws require.
• Our handling of personal data is described in the Privacy Policy.

4. Connected ad accounts

When you connect an advertising or search account you confirm you are authorised to do so. Changes made through Kite (for example creating campaigns, audiences or conversion settings, changing budgets or pausing campaigns) are made on your instruction and take effect in your account on that platform. You remain responsible for your ad spend, your ads’ content and compliance with each platform’s own policies. Review changes before you make campaigns live.

5. Acceptable use

You must not:

• Use Kite for anything unlawful, or to track people in ways their laws do not allow.
• Send us data you have no right to share, or sensitive personal data the service is not designed for.
• Attempt to access other customers’ data, probe or disrupt the service, or work around its limits.
• Resell or copy the service, or reverse engineer it except where the law allows.

6. AI-generated content

Insights, recommendations and drafts produced by AI can be wrong or incomplete. Check them before relying on them or acting on them, especially before spending money.

7. Fees

Paid plans or client agreements set out any fees. Unless agreed otherwise, fees are charged in advance and are non-refundable except where the law requires.

8. Availability and changes

We aim to keep Kite running reliably but do not guarantee it will be uninterrupted or error-free. Third-party platforms (Google, Meta, Microsoft, TikTok and others) can change or withdraw their APIs, which may affect features.

9. Suspension and termination

You can stop using Kite and ask us to close your account at any time. We may suspend or close accounts that breach these terms or put the service or other users at risk. On closure, data is handled as described in the Privacy Policy.

10. Disclaimers and liability

To the extent the law allows, the service is provided “as is” and we exclude implied warranties. We are not liable for indirect or consequential losses, lost profits, or ad spend, and our total liability for any claim is limited to the fees you paid us for the service in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be excluded.

11. Changes to these terms

We may update these terms. Material changes will be announced in the app or by email before they take effect. Continuing to use Kite after that means you accept them.
